Terms of Service

In short: try Emaki free for 7 days, then pay once to keep using it on up to 3 computers. Your notes and maps are yours. If it isn’t for you, you get your money back within 30 days of buying. The app is provided as it is, and you use it at your own risk.

Who we are

Emaki is made by Runar Hummelsund, a sole trader in Norway (“we”). Questions are welcome at support@getemaki.app.

Agreeing to these terms

These terms apply when you download, install, use or buy Emaki. By doing any of those, you agree to them. If you don’t agree, don’t use Emaki. If you use it for an organization, you agree to them on its behalf too.

The free trial

You can use all of Emaki free for 7 days on each computer. After that, you need a license to keep using the app.

Your license

Paying

Licenses are sold through Stripe, which processes the payment and acts as the seller, or merchant of record, for the purchase. Stripe’s terms also apply to the payment, and the charge appears from Link on your statement. Prices include any sales tax or VAT, and are shown in your currency.

Refunds

If Emaki isn’t right for you, email support@getemaki.app within 30 days of buying for a full refund, no questions asked. Your key stops working once it’s refunded. This doesn’t limit any right to a refund you have by law.

Your content and your use

Your notes and maps are saved as files on your computer, where you choose, and they stay yours. Emaki doesn’t upload them, and we can’t see them. That also means keeping them safe is up to you: keep backups of anything that matters, and we aren’t responsible for files that are lost, damaged or exposed, including through your computer, sync services or other apps.

You’re responsible for how you use Emaki, for what you put in it, and for following the laws that apply to you. Emaki isn’t made for uses where a failure or lost data could cause injury, harm or serious loss, so don’t rely on it alone for those.

Other software and services

Emaki includes open-source software, which comes under its own licenses. Payments, hosting and the App Store are provided by Stripe, Cloudflare and Apple, under their own terms, and we aren’t responsible for their services.

No warranty

Emaki is provided “as is” and “as available”. As far as the law allows, we make no promises or warranties of any kind, express or implied. In particular, we don’t promise that it will be free of bugs, work without interruption, keep your data safe, work with other software or hardware, or be fit for any particular purpose.

Limits on our liability

As far as the law allows, we aren’t liable for any indirect, incidental, special or consequential loss, or for lost data, profits, income, business or goodwill, that comes from using Emaki or being unable to use it, even if we were told it could happen. Our total liability for anything to do with Emaki is limited to what you paid for your license, or nothing if you haven’t bought one.

These limits don’t apply to liability that the law doesn’t allow us to limit, such as for intent or gross negligence. Nothing here limits rights you have as a consumer that can’t be waived by agreement.

Claims caused by you

If someone makes a claim against us because you broke these terms or the law while using Emaki, you’ll cover our resulting losses and reasonable costs, as far as the law allows.

Ending

You can stop using Emaki at any time. If you break these terms, we may end your license and turn off your key, and you must then stop using the app. The parts of these terms on warranty, liability and claims still apply after that.

Changes

We may update these terms, and will change the date at the top when we do. If you keep using Emaki after a change, the new terms apply. Changes don’t take away a license you’ve already bought.

General

These terms, along with our privacy policy and the seller’s terms for your purchase, are the whole agreement between you and us about Emaki. If any part of them can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still do so later.
